Introduction of Rospatent

The FederalService for Intellectual Property (Rospatent) is the federal executive authority of the Russian Federation in charge of control and supervision in the area of legal protection and use of intellectual property rights, including patents and trademarks.

Rospatentisthe legal successor of the Federal Service for Intellectual Property, Patents and Trade Marks, as well as successor of the Ministry of Justice of the Russian Federation in terms of continuity of functions related to defense of interests of the State in the process of economic and business turnover of the results of research and development activities of military, special and dual purposes, including with regard to implementation of liabilities due in course of execution of court decisions.

Rospatent is currently subordinate to the Ministry of Economic Development of the Russian Federation.

The main functionsof Rospatent include the following:

- legal protection of interests of the State in the process of economic and business turnover of the results of research and development activities of military, special and dual purposes;

- control and supervision in the area of legal protection and use of the results of intellectual activities of civil, military, special and dual purposes created at the expense of allocations from the federal budget;

- control and supervision in the designated area with regard to state customers and organizations under the state contracts that provide for carrying out research and development activities;

- providing state services in the area of legal protection of inventions, utility models, industrial designs, computer programs, databases and layout designs of integrated circuits, including those making part of a single technology, trademarks, service marks, appellations of origin of goods, as well as ensuring legal and normative regulation of issues related to control, supervision and provision of state services in the said designated area of activities.
